Can AI Music Be Copyrighted?
AI-assisted music can contain copyrightable human authorship, but there is no official rule saying a song must be 40%, 60% or any other percentage human-created. The real question is whether a person contributed identifiable, sufficiently creative expression to the work being claimed.
The practical answer
The U.S. Copyright Office says generative-AI output may be protected only where a human author determined sufficient expressive elements. Protection may apply when human-authored material remains perceptible in the result, or when a person makes copyrightable creative selection, arrangement or modification. Merely entering prompts is generally not enough by itself.
Using AI does not automatically disqualify a larger work. A creator may be able to claim the human-written lyrics, a human performance, an original melody, a creative arrangement, production authorship or another identifiable contribution while excluding unclaimable AI-generated material.
There is no percentage test
What does not exist
- No official 40–60% human threshold.
- No automatic 70–85% safe zone.
- No rule that replacing a set number of stems guarantees protection.
- No guarantee that heavy effort alone equals copyrightable authorship.
What actually matters
- Which expressive elements a person created.
- Whether those contributions are sufficiently original.
- Whether they remain identifiable in the final work.
- Whether AI-generated material is accurately disclosed and excluded from the claim when required.
Human contributions that may matter

A safer creator workflow
1. Start with material you control
Write the lyrics, melody, hook, chord direction or source recording yourself when possible. Do not upload music, voices or samples you do not own or have permission to use.
2. Treat AI output as a component
Decide what the generator contributed and what you contributed. Avoid claiming that every part was human-authored when it was not.
3. Make creative decisions you can identify
Record new performances, rewrite sections, create original melodies, arrange the work and make meaningful production choices because they serve the song—not to chase an invented percentage.
4. Preserve evidence
Save lyrics, demos, dated drafts, prompts, generated versions, stem exports, session files, edit notes, contributor permissions and final masters.
Composition and sound recording are different
A song can involve more than one copyright interest. The musical composition covers elements such as music and lyrics. The sound recording covers the recorded performance and production embodied in the audio file. Your human contribution may be stronger in one layer than another.
For example, you might write all lyrics and record your own vocal performance while using AI-generated accompaniment. That does not automatically mean you own every element of the underlying composition, but the lyrics and human performance may present distinct authorship questions.
Registration and disclosure
When applying to the U.S. Copyright Office, information must be accurate. Applicants have a duty to disclose AI-generated content and should limit the claim to copyrightable human-authored material. The correct application and limitation-of-claim language depend on the facts of the work.

What not to do
- Do not invent or repeat a percentage threshold.
- Do not assume a paid AI subscription guarantees copyright registration.
- Do not assume commercial-use permission from a platform equals copyright ownership.
- Do not claim AI-generated portions as human-authored.
- Do not use another person’s voice, music, lyrics, samples or recordings without permission.
- Do not destroy earlier versions that show your human process.
Build the rights record while you build the song
The strongest practical move is not to retrofit a story after release. Keep a clear creation record from the first lyric or demo through the final export.
